Agreement on Terms of Service (hereinafter referred to as Agreement)

"First QueenⅠ" and "First QueenⅠNEXT" (hereinafter referred to as "Games") are games provided by Kure Software Kobo Co., Ltd. (hereinafter referred to as "Kure Software").
Customers who use the Games (hereinafter collectively referred to as "User") shall confirm this Agreement before using Games and agree to all of its conditions.

The Games are only available for ages 12 years and older.
Children under the age of 12 years may only use the Games if their parents or guardians agree to this Agreement.

Article 1. Application of Agreement
1. This Agreement applies to any and all matters related to the use of the Games between the User and Kure Software, as well as the license agreement.
2. Kure Software may make various provisions (hereinafter referred to as "Individual Provisions") such as rules and guidelines for use in addition to this Agreement with respect to Games. Regardless of their naming, these individual provisions shall constitute a part of the Agreement.
3. If the provisions of the Agreement conflict with the provisions of the Individual Provisions of the preceding article, the Agreement shall take precedence unless otherwise specified in the Individual Provisions.

Article 2. Usage of This Game
1. The User may install and use the Games on devices such as game consoles owned by the User (including devices owned by legal representatives such as parents who have consented to usage by the User if the User is a minor).
2. The preparation and maintenance of devices, communication services, and other equipment necessary to use This Game shall be the responsibility and expense of the User.
3. The User shall install the Games for the sole purpose of their own use, and shall not install the Games on multiple devices.
4. If the User is a minor, the user shall use the Games after obtaining prior consent from a legal guardian such as a person with parental authority regarding the content of this Agreement and the use of Games.
5. If a User who was a minor at the time of starting the use of Games continues the use of Games after reaching the official age of adulthood, it shall be deemed that the User has confirmed all usage of Games while the User was a minor.
6. The User shall use Games at their own responsibility, and any damage or harm caused to others or Kure Software during this use, the User shall compensate for such damages at the User's own responsibility and expense.
7. The Use of Games may be terminated without prior notice and the User may not be able to use the Games when the service from Kure Software is terminated and no longer provided.

Article 3. Notification/Changes to the Terms
1. Kure Software may arbitrarily change the contents of this Agreement at any time as Kure Software deems necessary. In this case, Kure Software will post a notice to that effect on its website or through any other appropriate means and shall notify the user of the content of such revised terms, the effective date of the revisions, and other necessary information.
2. If the Agreement, etc. are changed and the User continues the use of the Games after the time when the changes come into effect, the User shall be deemed to have agreed to the changes in the Agreement, etc.
3. The User shall check the content of the Agreement and any changes on the website of Kure Software, regardless of whether or not there are any notifications from Kure Software.
4. Kure Software shall not be liable for any damages incurred due to the failure of the User to check the contents of the Agreement for whether or not there have been any changes.

Article 4. User Data Management
1. Kure Software may collect information related to the Games from the User for reference in product development, etc. However, Kure Software does not collect personal information of the User. Kure Software adheres to privacy policies and treats them appropriately.
2. The User shall strictly manage Games data by themselves and shall not disclose, lend, transfer, buy or sell, inherit or pledge the data to any third party.
3. Kure Software shall not be liable for any loss or damage of data due to acts of the User or a third party, natural disasters, power outages or other force majeure.

Article 5 Transmission of information by User
1. All representations and displays such as content, images, videos, music, etc., of related to games sold by Kure Software and with Games are copyrighted by Kure Software or the copyright holder, and may not be reproduced or distributed without permission.
2. If the User wants to distribute play videos of the Games (including BGM) through a video-sharing site such as "YouTube", the User must display the copyright holder of the Games after complying with the terms of use of the video-sharing site.
3. The User shall be fully responsible for the video distribution and information they transmit, and Kure Software does not make any guarantees of such distribution by the User. In the event of a dispute with a third party regarding such information, Kure Software will not be involved in such disputes and will not provide compensation.
4. Upon request from Kure Software, Kure Software may ask the User to delete or remove any images, videos, and other similar postings without delay for any reason Kure Software deems necessary and the User shall comply.

Article 6. Prohibited Matters
1. Acts that violate laws or public order and morals.
2. Acts related to criminal activity.
3. Acts that infringe on copyrights, trademark rights, and other intellectual property rights contained in Games, such as the content of Games.
4. Acts that may interfere with the operation of Kure Software.
5. Illegal access to Games, downloading pirated Games or access to illegal sites providing access to pirated Games, modification of Games, or attempting reverse engineering, or any attempt to do so.
6. Acts of collecting or accumulating personal information, etc. related to other Users.
7. Acts of using the Games for illegal purposes.
8. Acts that cause disadvantage, damage, or discomfort to other Users of Games or any other third parties.
9. Any act of impersonating another User.
10. Acts of distributing videos and posting information on the Internet that Kure Software deems inappropriate.
11. Other acts that Kure Software deems inappropriate.

Article 7. Disclaimer
1. Kure Software does not warrant, express or imply, that the Games will be free from factual or legal defects (including, without limitation, safety, reliability, accuracy, completeness, validity, fitness for a particular purpose, security defects, errors, bugs, or infringement).
2. Kure Software will not be liable for any damages incurred to the User due to the Games, except due to the willful misconduct or gross negligence of Kure Software. However, this disclaimer does not apply if the contract between the Company and the User regarding Games (including this Agreement) is a consumer contract as defined in the Consumer Contract Act.
3. Even in the case stipulated in the proviso of the preceding paragraph, Kure Software shall not be liable for any damage caused to the User due to default or tort due to Kure Software's negligence (excluding gross negligence) and damages arising from special circumstances.
4. Kure Software shall not be liable for any transactions, communications, disputes, etc. that occur between the User and other Users or third parties regarding the Games.
5. The User shall determine the place, time, fees, etc. for use of the Games by the User and avoid excessive use. Kure Software shall not be liable for any damages incurred to the User in the event that the User suffers physical or mental disabilities, social or economic problems, or other problems due to excessive use of the Games.

Article 8 Compensation for Damages
1. If the User causes damage to Kure Software due to a violation of this Agreement or other reasons attributable to the User, the User shall compensate Kure Software for such damages.
2. Compensation for damages incurred by the User due to default or tort due to the Kure Software's negligence (excluding gross negligence) shall be limited to the amount actually paid by the User.

Article 9 Prohibition of Transfer of Rights and Obligations
1. User may not assign or pledge as collateral to a third party its status under the Service Agreement or its rights or obligations under these Terms without the prior written consent of Kure Software.

Article 10 Governing Law and Jurisdiction
1. In interpreting this Agreement, Japan law shall be the governing law.
2. In the event of any dispute regarding the Games, the court having jurisdiction over the location of Kure Software shall be the exclusive agreement jurisdiction.
